1. Introduction and Acknowledgment: Welcome to Spirit of Tanzania Safaris, a premier luxury experiential travel company in Africa. By using our services, you acknowledge and agree to these Terms and Conditions, forming a legal contract governed by the laws of the United Republic of Tanzania. Spirit of Tanzania Safaris is headquartered in Tanzania.

Your agreement is established with Spirit of Tanzania Safaris. Before reserving your Holiday Trips, please carefully review and fully understand our terms and conditions to prevent any administrative or unnecessary issues. Spirit of Tanzania Safaris, henceforth referred to as “Spirit of Tanzania Safaris,” “us,” or “we,” operates as a premier travel company specializing in unique travel experiences across Africa, including destinations such as South Africa, Namibia, Botswana, Zimbabwe, Zambia, Madagascar, Seychelles, Mauritius, Rwanda, Uganda, Kenya, Tanzania, and Mozambique.

Placing a booking, whether through email or other means, is considered an acknowledgment that the guest has read the terms and agrees to comply with them. Spirit of Tanzania Safaris’ Trading Terms of Service are applicable for the duration of this Agreement and pertain to all operational divisions of Spirit of Tanzania Safaris LIMITED unless stated otherwise.

2. Privacy Policy Overview: Our Privacy Policy, detailed on our website, outlines our commitment to protecting your personal information. We encourage you to review it to understand our data handling practices.

3. User Conduct and Obligations: Clients are expected to conduct themselves responsibly and adhere to local laws and customs. Prohibited behaviors include any illegal activities and actions that cause distress or damage.

4. Intellectual Property Rights: All website content, including texts, images, and logos, is the property of Spirit of Tanzania Safaris. Unauthorized use of this material is prohibited.

5. Security and Account Responsibility: If our services require account creation, you are responsible for maintaining its confidentiality and all activities under your account.

6. Amendments to Terms and Conditions: We reserve the right to modify these Terms and Conditions. Changes will be effective immediately upon posting on our website.

7. Limitation of Liability and Disclaimer: Spirit of Tanzania Safaris disclaims liability for inaccuracies or omissions on our website and for indirect or consequential damages related to the use of our services.

8. Governing Law and Jurisdiction: These Terms and Conditions are governed by the laws of the United Republic of Tanzania.

9. Contract Termination: Either party may terminate this agreement under specified conditions, following Tanzanian law.

13. Booking and Payment Process: Spirit of Tanzania Safaris will personalize your travel experience to suit your individual preferences. A binding contract between you and Spirit of Tanzania Safaris will be established provided you fulfill the conditions outlined below:

  • Reservations must be documented and confirmed through email.
  • To confirm your booking, a deposit of 30% of the total cost of the safari, which is non-refundable, must be made.
  • After accepting the safari itinerary, you are to confirm your booking by depositing the specified 30% within seven days.
  • The remaining 70% of the safari cost is due 45 days prior to the commencement of the safari. Failure to meet this payment deadline allows Spirit of Tanzania Safaris the authority to cancel the booking and retain the deposit as a forfeiture.
  • Should a safari be organized within 45 days before it begins, the entire amount will be required to confirm the booking.
  • A contractual relationship will not be established if these specified requirements are not met.

14. Documentation and Travel Requirements: Please promptly review your invoice, tickets, itinerary, receipts, and any other documents related to your holiday trip upon receipt. Address any discrepancies or missing information within 7 days of your booking confirmation. Beyond this 7-day period, we cannot accept liability for any missing or incorrect information, and any necessary corrections will be your responsibility unless the error originated from us.

Upon safari confirmation, provide copies of all travelers’ passports, your international flight details (including arrival and departure dates), and a valid travel insurance certificate. Additionally, provide documentation regarding the health and medical condition of travelers, as verified by a certified physician.

15. Health, Medical Conditions, and Special Requirements: To ensure the safety and enjoyment of your holiday, inform us of any health concerns, allergies, or disabilities that any member of your party may have before confirming your booking. This information allows us to offer guidance and make necessary arrangements. Failure to disclose such information in advance may limit our ability to meet these needs effectively and ensure a seamless holiday experience.

16. Cancellation and Refund Policy: To cancel your holiday, communicate formally in writing. A cancellation will only be considered valid once we have received written notification.

  • Cancellations 120 to 60 days prior to departure incur a forfeiture of the 30% deposit.
  • Cancellations 60 to 45 days prior incur a 50% fee of the total tour rate.
  • Cancellations less than 45 days prior incur a 100% cancellation fee.

Travel insurance is highly recommended to cover unforeseen cancellations. If your cancellation falls within the coverage scope of your insurance policy, you may be eligible to recover the incurred charges from your insurance provider. However, if we have already issued your domestic airline tickets and you cancel, no refunds for these tickets will be given. If you fail to show up or join the safari after the departure date, no refund will be issued.

17. Pricing and Itinerary Adjustments: (All prices are in United States Dollars) The cost of your travel itinerary is based on known expenses as of the date your confirmed itinerary is issued. We retain the right to adjust and correct pricing errors before confirming your holiday. Should any modifications in government laws or policies influence pricing, and such changes are beyond our control, the resulting increase in costs will be borne by the clients. Factors that may lead to price adjustments include variations in transportation expenses, government-imposed taxes, concession fees, fuel prices, scheduled flight fares, additional airline levies, or charges for services like landing taxes, or fees for embarking or disembarking at ports or airports, as well as hikes in park, reserve, or concession fees.

18. Tour Operator’s Rights and Responsibilities: We reserve the right to cancel or alter itineraries due to unforeseen circumstances, including force majeure events.

We reserve the right to cancel your holiday at any time before receiving the full payment, for any reason. We will not accept liability or pay compensation if we are unable to fulfill our contractual obligations due to circumstances beyond our control, referred to as force majeure. Force majeure encompasses any event that could not be anticipated or avoided, even with utmost care, by us or our service providers.

Should any changes or modifications become necessary, we will implement these adjustments promptly. All modifications must be documented and communicated in writing. Should circumstances beyond our control arise, necessitating a significant change to any of the primary features of the travel services included in your confirmed booking, we will inform you as soon as possible. If you reject the changes or any alternative options provided, you can cancel the booking and get a full refund.

In certain situations, we may need to cancel confirmed holiday plans. If unavoidable and extraordinary circumstances prevent us from fulfilling your confirmed arrangements, we reserve the right to terminate your contract and cancel your holiday. Should we cancel your holiday under these conditions, we will refund any payments you have made to us within 14 days of notifying you about the cancellation. We also reserve the right to cancel your booking if you fail to meet the payment deadlines outlined in your contract.

19. Changing Booking, Client Responsibility, and Conduct: After our contract is established, if you decide to modify your itinerary, we will endeavor to accommodate your requests, provided they are submitted in writing. Your changes will be forwarded to the appropriate supplier, but please be aware that we cannot guarantee these adjustments will be feasible.

You agree to conduct yourself in a manner that does not cause significant distress, danger, or annoyance to other clients or result in damage to property. If our staff, agents, or suppliers determine that your behavior is inappropriate, we reserve the right to terminate your contract without further obligation to you, including covering any expenses, compensation, refunds, or arrangements for your return home.

By booking with us, you accept responsibility for any damage or loss caused by your actions. You are required to make immediate payment for any such damage or loss. Failure to comply will make you liable for any subsequent claims made against us, including all legal fees incurred by both us and the other party, as a result of your actions.

You are obligated to check and comply with the current passport, visa, and health requirement guidelines for your destination well before your departure. Should your failure to secure the necessary travel documents result in fines, penalties, or costs being incurred by us, you will be liable to reimburse us for those expenses.

The name on your airline tickets must match precisely with the name as it appears on your passport. Should there be any discrepancy between what has been communicated to you verbally regarding the availability of specific facilities or services and what is detailed in your confirmed itinerary or provided to you in writing by us, you are required to mention this discrepancy on the booking form/Guest Information form.

Participating in holidays to Africa, as offered by us, inherently involves certain risks. You must acknowledge and assume these risks on your own behalf. Should you wish to discuss any specific risks associated with your holiday, we are available and willing to provide guidance and advice.

20. Carriers and Transportation: Transportation by air and sea is governed by the terms and conditions of the carriers with whom you travel, as well as international conventions, and does not fall
